El propósito de este artículo es identificar convergencias y diferencias acerca de la relación fe-cultura en las reflexiones de tres teólogos latinoamericanos, quienes representan, de alguna manera, tres grandes líneas teológicas de los últimos cincuenta años. Los tres autores convergen en su interés por conocer e interpretar la cultura latinoamericana y su relación con el Evangelio. Pero divergen en una variedad de aspectos. Esto se puede apreciar por los conceptos, o categorías, utilizados: la idea de la liberación sociocultural como implicación (...) de la misma evangelización, la idea de una síntesis entre las culturas originarias y la evangelización ibérica, y la idea que valora la realidad multiétnica y pluricultural de nuestro subcontinente. Los tres autores estudiados muestran más diversidad que convergencia, e incluso, oposición entre sus planteamientos y opciones pastorales. The purpose of this article is to identify similarities and differences about the relationship between faith and culture in the reflections of three Latin American theologians who represent, somehow, three great theological lines cin-account recent years. The three authors converge in their interest to know and interpret Latin American culture and its relationship with the Gospel. But they diverge in a variety of ways. This can be seen by concepts, or categories, used the idea of cultural liberation as involvement in the same evangelization, the idea of a synthesis between the native cultures and the Iberian evangelization, and the idea that values the multiethnic and multicultural reality of our continent. The three authors studied show more diversity than convergence, and even opposition between his approach and pastoral options. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Este artigo propõe a discussão da educação escolar tomando como ponto de partida a burocracia, a racionalidade e o conceito de desencantamento do mundo proposto por Max Weber. Por fim, discutimos os impactos para a subjetividade dos principais envolvidos no processo educacional – professor e aluno – para sinalizar possíveis movimentos que tornem mais dinâmica as relações humanas na educação institucionalizada.

In this paper, I aim to discuss New Political Economy as a label for the economic analysis of politics, in the English language. The term 'political economy' itself, although it has ceased to be the preferred term by which economists refer to their discipline, it is still being used by a variety of scholars, especially for interdisciplinary research with political science, international relations and other social sciences. Marxist- inspired social scientists also have a claim on the term 'political economy'. The (...) term gained relevance again with economists, in the 1950s, thanks to various critiques of orthodox economics, especially to the theory of economic policy and to economic planning. They ignored issues of political economy, such as the self- interest of politicians. The public choice movement revived these issues by applying rational choice theory to politics and preferred the label “public choice” to designate its movement. Scholars and traditions not affiliated with the public choice movement prefer the label '(new) political economy' to refer to their own economic analysis of politics. The search for a proper label is still ongoing, but they show how they can differentiate their objectives and affiliations. (shrink)

Resumen: Este artículo tiene como objetivo ofrecer al lector un análisis de las figuras antropomorfas conocidas como dogū, que fueron elaboradas durante el período Jōmon de la prehistoria japonesa. Para ello, en primer lugar, será necesario esclarecer sus orígenes y evolución a partir del conocimiento arqueológico acumulado hasta la actualidad, que pondrá de relieve un proceso gradual de complejización tipológica, desde formas primarías hasta un intento de trascender la representación del cuerpo humano. Al mismo tiempo, también se deberá prestar atención (...) a su diversidad sincrónica, marcada por diferentes tipos con una mayor o menor presencia en el marco espacial del archipiélago. Esta labor permitirá no sólo delimitar las diferentes etapas protagonizadas por estas figuras, sino también esclarecer su posible significado y uso. Presentism is the view that only present entities exist. Recently, several authors have asked the question whether presentism is able to account for cross-time relations, i.e., roughly, relations between entities existing at different times. In this paper I claim that this question is to be answered in the affirmative. To make this claim plausible, I consider four types of cross-time relation and show how each can be accommodated without difficulty within the metaphysical framework of presentism.

Quelle est la tâche – plutôt que la contribution – de la philosophie à l’égard du langage? Dans cet article, il s’agit de revisiter la réponse de Paul Ricœur à cette question, à partir de son texte “Philosophie et langage.” Ricœur assigne à la philosophie la tâche de se réapproprier la triple médiation langagière: “chemin” du langage vers monde, “chemin” du langage vers le sujet et “chemin” du langage vers la communauté humaine. Partant de l’expérience concrète des sujets parlants, Ricœur (...) s’oppose à la clôture systémique présupposée par la conception structuraliste du langage, qui suspend la fonction de la référence dans la relation de signification. À partir d’une conception élargie de la référence – qui inclut la fonction poétique du langage –, le philosophe dégage de la notion de “monde du texte” la dimension ontologique constitutive du langage: dans sa fonction poétique, en effet, le langage révèle, selon lui, les possibilités multiples de notre mode d’existence. Nous montrons enfin que c’est à travers la notion d’attestation que Ricœur établit une connexion entre la réouverture de la triple médiation du langage et l’élaboration de cette nouvelle ontologie. Corporations perform actions that can inflict harm with different levels of intensity, from death to material loss, to both companies’ internal and external stakeholders. Research has analysed corporate harm using the notions of corporate social irresponsibility and corporate crime. Critical management studies have been subjecting management and organizational practices and knowledge to critical analysis, and corporate harm has been one of the main concerns of CMS. However, CMS has rarely been deployed to analyse CSIR and corporate crime. Thus, the aim (...) of this paper is to critically analyse the perspectives of CSIR and corporate crimes on corporate harm via CMS in general and postcolonial studies in particular. The paper contributes by arguing that research on CSIR and corporate crime could be perceived as producing research that does not challenge the essence of contemporary corporation profit-seeking activities that ultimately produces corporate harm. We argue that CSIR and corporate crime are ideologies that assist in disguising the contradiction between producing shareholder value and the social good that is at the heart of the modern corporation system and the current economic system. Furthermore, the postcolonial view of CSIR and corporate crime highlights how they are based on a Western-centric view of corporate harm that ignores the realities and perspectives of the Global South, especially in situations where corporate harm leads to death in the Global South. One of the oldest platitudes about beauty is that it is pleasant to perceive or experience. In this article, I take this platitude at face value and try to explain why experiences of beauty are seemingly always accompanied by pleasure. Unlike explanations that have been offered in the past, the explanation proposed is designed to suit a “realist” view on which beauty is an irreducibly evaluative property, that is, a value. In a nutshell, the explanation is that experiences of beauty (...) are experiences in which it appears that something is beautiful, and that such experiences are identical to experiences of aesthetic pleasure. If possible worlds are conjunctions of states of affairs, as in David Armstrong’s combinatorial theory, then is the empty world to be thought of as the null conjunction of states of affairs? The proposal seems plausible, and has received support from David Efird, Tom Stoneham, and Armstrong himself. However, in this paper, it is argued that the proposal faces a trilemma: either it leads to the absurd conclusion that the actual world is empty; or it reduces to a familiar representation (...) of the empty world in which the concept of a null conjunction plays no role; or it needs to make room for the null individual of certain non-classical mereologies. Art restorations often give rise to controversy, and the reason does not always seem to be a lack of skill or dedication on the side of the restorer. Rather, in some of the most famous cases, the reason seems to be a lack of agreement on basic principles. In particular, there seems to be a lack of agreement on how the following two questions are to be answered. First, what is art restoration supposed to achieve, in other words, what is (...) the goal of restoration? Second, how can this goal be achieved, in other words, what are the means that a restorer can legitimately make use of? In this paper, I formulate, and defend, a principle that answers these questions. Although the principle may sound platitudinous, it has been contradicted by prominent philosophers and by important organizations concerned with conservation. Moreover, defending the principle turns out to be impossible without touching on such vexed philosophical issues as the ontology and identity of artworks, as well as the nature of perceptual and aesthetic properties (including the nature of artistic value). Aesthetic properties are often thought to have either no evaluative component or an evaluative component that can be isolated from their descriptive component. The present article argues that this popular view is without adequate support. First, doubt is cast on the idea that some paradigmatic aesthetic properties are purely descriptive. Second, the idea that the evaluative component of an aesthetic property can always be neatly separated from its descriptive component is called into question. Meanwhile, a speculative hypothesis is launched regarding (...) the structure of being garish and being cacophonous. Finally, an explanation is given of how the issue of the structure of aesthetic properties bears on their reality and (presumed) response-dependence. (shrink)

Criteria of identity should mirror the identity relation in being reflexive, symmetrical, and transitive. However, this logical requirement is only rarely met by the criteria that we are most inclined to propose as candidates. The present paper addresses the question how such obvious candidates are best approximated by means of relations that have all of the aforementioned features, i.e., which are equivalence relations. This question divides into two more basic questions. First, what is to be considered a ‘best’ approximation. And (...) second, how can these best approximations be found? In answering these questions, we both rely on and constructively criticize ground-breaking work done by Timothy Williamson. Guiding ideas of our approach are that we allow approximations by means of overlapping equivalence-relations, and that closeness of approximation is measured in terms of the number of mistakes made by the approximation when compared to the obvious candidate criterion. A series of unnoticeably small changes in an observable property may add up to a noticeable change. Crispin Wright has used this fact to prove that perceptual indiscriminability is a non-transitive relation. Delia Graff has recently argued that there is a 'tension' between Wright's assumptions. But Graff has misunderstood one of these, that 'phenomenal continua' are possible; and the other, that our powers of discrimination are finite, is sound. If the first assumption is properly understood, it is not in tension (...) with but is actually implied by the second, given a plausible physical assumption. (shrink)

Libertarian philosopher Michael Huemer has argued recently that there is a prima facie right to immigrate, and, moreover, that concerns people have about the effects of immigration are not strong enough to neutralize or override this prima facie right. In this paper, I focus on one particular concern that Huemer deems insufficiently strong to neutralize or override the prima facie right to immigrate, namely, the concern that unrestricted immigration poses a threat to one’s culture. The paper argues that an important class of aesthetic terms cannot be used as metaphors because it is impossible to commit a category mistake with them. It then uses this fact to provide a general definition of 'aesthetic property'.

In recent issues of this journal, Roger Scruton and Malcolm Budd have debated the question whether hearing a melody in a sequence of sounds necessarily involves an ‘unasserted thought’ about spatial movement. According to Scruton, the answer is ‘yes’; according to Budd, the answer is ‘no’. The conclusion of this paper is that, while Budd may have underestimated the viability of Scruton's thesis in one of its possible interpretations, there is no good reason to assume that the thesis is true. Very briefly, the argument for the second part of the conclusion is that we can account for all the data adduced by Scruton in favour of his hypothesis by means of hypotheses that are far less daring. The traditional conception of response-dependence isinadequate because it cannot account for all intuitivecases of response-dependence. In particular, it is unableto account for the response-dependence of (aesthetic, moral, epistemic ...) values. I therefore propose tosupplement the traditional conception with an alternativeone. My claim is that only a combination of the twoconceptions is able to account for all intuitivecases of response-dependence.

For centuries, it has been recognized that beauty can move. My aim in this paper is to understand how beauty moves. One suggestion is that beauty moves in a causal way, for example, by causing us to have certain feelings. Four objections to this suggestion are considered, but none is found convincing in the light of how causation tends to be understood. Moreover, it turns out that there is positive reason for thinking that beauty is causally efficacious, not just once (...) it has been experienced, as John Hyman has suggested, but even in bringing about the experience on which all other effects of beauty depend. En este trabajo se presentan cinco grandes desafíos de la teoría de los derechos: el poder de los derechos, la satisfacción de los derechos evidentes, la regulación de las tecnologías disruptivas, la vulnerabilidad y la discriminación y la formación y concienciación.

La enseñanza de las confrontaciones producidas a lo largo del siglo XX, y en especial durante la Segunda Guerra Mundial sigue siendo un tema controvertido en la didáctica de las Ciencias Sociales. Tomando como referencia el currículo de cuarto de la ESO, y en especial el bloque décimo de la materia de Geografía e Historia, esta comunicación selecciona una serie de materiales didácticos cartográficos de indudable utilidad en los procesos de enseñanza-aprendizaje de la relación entre el pasado, el presente y (...) la proyección al futuro a través de estas dos disciplinas referentes. Además del estándar de aprendizaje referido al Holocausto, esta propuesta didáctica –fundamentada en los proyectos europeos Youthmetre y EuropeanValuesStudy- procura dar cumplimiento a la comprensión de las causas por las que una Europa en guerra durante el siglo XX ha podido llegar a una unión económica y política en el siglo XXI. Recently, several authors have claimed to have found graph-theoretic counterexamples to the Principle of the Identity of Indiscernibles. In this paper, I argue that their counterexamples presuppose a certain view of what unlabeled graphs are, and that this view is optional at best.

This article is a reply to Dominic McIver Lopes, 'Shikinen Sengu and the Ontology of Architecture in Japan,' published in The Journal of Aesthetics and Art Criticism 65 (2007). The reply explains how the standard ontology of architecture is able to accommodate Japanese shrines such as Ise Jingu.

The aim of this paper is to achieve a better understanding of why modern buildings do not easily harmonize with one another. After proposing, and defending, an analysis of the concept of architectural harmony, the paper turns to three possible views on whether we can expect more harmony from modern architecture in the future.

Pelo menos desde o século XIX, a relação entre o pessimismo e a política tem suscitado o debate entre diversos filósofos, cujas leituras têm apontado para compreensões bastante opostas. Por um lado, há a leitura tradicional, que aproxima Schopenhauer, o fundador do pessimismo moderno, de uma concepção política conservadora, como é o caso das críticas feitas por Lukács. Por outro lado, há uma apropriação crítica, por parte de uma assim chamada “esquerda schopenhaueriana”, de aspectos desse pessimismo, como fazem Mainländer, Lütkehaus, (...) Horkheimer e a escola de Teoria Crítica. Neste artigo, buscamos analisar algumas categorias de pensamento político, social e econômico de Schopenhauer e as distintas leituras de sua filosofia. Resumo: Este artigo pretende contribuir para a elucidação da nossa compreensão sobre a educação, sobre os fenômenos e processos educacionais, que constituem uma ocupação e uma preocupação humana fundamental. O método que utilizamos nesta pesquisa consistiu, num primeiro momento, de uma análise etimológica da palavra latina educo, da qual derivou a palavra educação em português, e, num segundo momento, da interpretação de alguns sentidos da palavra educo à luz de algumas ideias da filosofia da educação, encontradas em cada um dos (...) quatro períodos da história da filosofia. Concluímos constatando que, através de nossa análise, pudemos contribuir para expandir os limites do nosso conhecimento sobre a educação. Modern buildings do not easily harmonize with other buildings, regardless of whether the latter are also modern. This often-observed fact has not received a satisfactory explanation. To improve on existing explanations, this article first generalizes one of Ortega y Gasset’s observations concerning modern fine art, and then develops a metaphysics of styles that is inspired by work in the philosophy of biology. The resulting explanation is that modern architecture is incapable of developing patterns that facilitate harmonizing, because such patterns would (...) humanize buildings and modern architecture is a homeostatic property cluster with a dehumanizing motive at its core. Echoing a distinction made by David Wiggins in his discussion of the relation of identity, this paper investigates whether aesthetic adjectives such as ‘beautiful’ are sortal-relative or merely sortal-dependent. The hypothesis guiding the paper is that aesthetic adjectives, though probably sortal-dependent in general, are sortal-relative only when used to characterize multifunctional artefacts. This means that multifunctional artefacts should be unique in allowing the following situation to occur: for some object x there are sortals K and K' such that x is (...) a beautiful K and also a K', but not a beautiful K'. Examples of multifunctional artefacts show that this is indeed a possibility. However, that multifunctional artefacts are unique in this respect will be demonstrated by a more principled argument, taking into account the nature of functions on the one hand, and the nature of artefact-classification on the other hand. The review of the Spanish Jesuits Razón y Fe started in 1901. Although its gestation began before the crisis of the 98, logically it was influenced by her. The paper summarizes the begining, its original purposes and presents lines among the almost a hundred years of its history.

In The Aesthetics of Architecture, Roger Scruton makes at least four claims about rightness of architectural proportion. The present paper lists those claims, briefly discusses the way they are related, and, finally, selects one as the topic of discussion: the claim that there cannot be an exact, mathematical definition of rightness of proportion. Scruton’s arguments for this claim are reviewed. The first is found to be substantially correct, whereas the second is found to rely on a mistaken assumption, namely the (...) assumption that rightness of proportion is relative to a point of view. The paper ends by arguing that either the real or the apparent proportions of a building have to be definitely right, and that neither can be allowed to be definitely wrong. (shrink)

Oases have served as sacred landscapes and sources of ritual plants in arid regions of the Old and New Worlds. We evaluate the Jesuit mission oases of the Baja California peninsula for their role in agrobiodiversity persistence, and extend theories of sacred landscapes and biodiversity conservation to agricultural species and practices. Jesuit missionaries on the peninsula introduced a suite of crops species and agricultural and water management systems that persist in the oases and have become an integral part of the (...) cultural and religious identity of the peninsula. The sacred landscapes of the oases are defined by elements of the Jesuit mission systems, such as water capture systems and irrigation canals, stone field borders and terraces, field gardens or huertas, groves of olive trees and date palms, and multi-tiered agroecosystems. Sacred practices—including pilgrimages, religious rites, and Catholic-based community celebrations—depend on the integrated “landscapes” of the oases and on the ritual use of wild and cultivated oasis plant species. We propose that some, though not all, of the peninsula oases may be considered as sacred landscapes responsible for maintaining heritage crop species, biodiversity, and traditional farming and foodways practices. According to Locke’s Principle, material objects are identical if and only if they are of the same kind and once occupy the same place at the same time. There is disagreement about whether this principle is true, but what is seldom disputed is that, even if true, the principle fails to constitute an applicable criterion of identity. In this paper, I take issue with two arguments that have been offered in support of this claim by arguing (i) that we can (...) have knowledge of past whereabouts, and so verify the right hand side of Locke’s Principle, without having to assess concrete identity claims first; (ii) that even under conditions of incomplete knowledge of past whereabouts we can use Locke’s Principle to decide concrete identity problems. This essay argues for two conclusions about functional beauty, as this notion has been understood by Parsons and Carlson in a recent book by the same name. First of all, it is argued that functional beauty either is not a distinct kind of beauty or that the members of this kind are not all and only instances of the property of looking fit. Second, it is argued that functional beauty is relative only to categories corresponding to essential functions. The second (...) conclusion contradicts what Parsons and Carlson write about functional beauty, but the first conclusion does not, since they agree that looking fit is not necessary for functional beauty. However, their agreement on this point is based on reasons that can be shown to be mistaken. Moreover, contrary to what Parsons and Carlson claim, looking fit can also be shown to be insufficient for functional beauty. (shrink)
